Legal Support for the Technological Policy of Data Economy Development and Public Administration Transformation: Challenges and Prospects

At the current stage of development of information law, relevant issues include supporting the modern technological policy of the Russian Federation and forming new mechanisms in this area, in connection with the implementation of the federal program “Data Economy and Digital Transformation of Public Administration”. In this regard, from the perspective of information law, the authors analyze the key aspects of data economy formation as a logical continuation of digital economy development within the framework of implementing the national project, considering the further development of the Russian Federation legislation in the context of digitalization. The primary purpose of the research is to identify promising directions for the development and systematization of information (digital) legislation, which stands at the forefront of legal regulation for the advancement of cross-cutting digital technologies. In the course of their work, the authors apply a set of general scientific and specific legal methods, including analysis, generalization, description, the formal logical method, and others, based on a systemic approach. The formal logical method is employed in the study of issues related to the formation of the conceptual and categorical apparatus for regulating the digital environment. Analysis and synthesis of the obtained results enable the formulation of conclusions regarding the improvement of Russian legislation in connection with the digital transformation of the state and society. Results: The article analyzes the provisions of Russia’s new technological policy, enshrined in the Federal Law “On Technological Policy in the Russian Federation and on Amendments to Certain Legislative Acts of the Russian Federation”. The paper identifies problems in the development of the conceptual and categorical apparatus, the formation and deepening of legal regulation of certain critical and cross-cutting digital technologies based on a systemic approach, with the aim of forming a data economy and the digital transformation of the state.
