Legal regulation of subjects membership of labour legal relations in a trade union organization

In this article the attempt is made to identify gaps, regarding separate issues of legal regulation of membership in a trade union organization and to formulate proposals on their elimination through the analysis of labour legislation norms and separate provisions of the Federal Law On trade unions, their rights and guarantees, in particular. During the conducted study the article authors have come to the conclusion that trade union legislation with regard to determining membership in a trade union organization is an imperfect and it needs to be amended. Because of the abusive practice by the subjects of labour legal relations a legislator faces the problem of clear regulate of a procedure of joining into a trade union organization. It is concluded that it is necessary to introduce a relevant norm to the Federal Law On trade unions, their rights and guarantees.
