The article describes the basic legal provisions and the features associated with the regulation of psychiatric care in such countries as the Russian Federation and the United States of America. The study time frame varies on the beginning of their adoption and implementation, up to the present stage, taking into account all the amendments and innovations. Comparative characteristics of the legal base on the legal section on involuntary hospitalization of patients with psychiatric profile, its timing, and order, shipping and civil conduct. As well, identified the main similarities and differences of the legislative framework for the provision of mental health care.
