The article deals with the problem arising at the legal regulation of the relations between the owners of non-residential premises and the householders society. The owners of non-residential premises to avoid the differences in payments and contributions for upkeep of the common property in apartment building have to make a contract with the householders society. In its turn, conclusion of the contract depends on the will of all owners of premises in the apartment building.
