Legal regulation of patronage in the Republic of Bashkortostan

In this article the institute of patronage or foster family is considered as a way of creating better living and education conditions for children in comparison with orphanages. On the example of the Republic of Bashkortostan the author points out advancing establishment of patronage in some regions of Russia with no federal regulation. On the basis of study and comparison of regional legislation the author concludes that it is necessary to regulate patronage by laws, as opposed to delegated acts. The patronage system of that Russian region allows to assign responsibilities of legal representation of the child between the authorized service, parents (child’s legal representatives) and foster parents. The author discusses the division of responsibilities to maintain and bring up children and believes that they can be divided between not only foster parents, guardianship authorities, but also the parents that are not deprived of their parental rights.
