Legal regulation of redevelopment and reconstruction of residential premises in apartment buildings: problems and prospects

The article provides a comprehensive analysis of the problems of legal regulation of redevelopment and reconstruction of residential premises in apartment buildings. The author examines the key concepts and norms of housing legislation regulating this area, identifies gaps and contradictions in legal regulation. Special attention is paid to the issues of distinguishing the concepts of "redevelopment", "reconstruction" and "reconstruction", the problems of coordinating redevelopment, the consequences of unauthorized reconstruction. Based on the analysis of judicial practice and scientific literature, the most acute problems of law enforcement related to the realization of the rights of homeowners and ensuring the safety of apartment buildings are identified. The author concludes that it is necessary to improve the legal regulation of redevelopment and reconstruction of residential premises by eliminating terminological contradictions, optimizing approval procedures, strengthening control over compliance with housing legislation, developing mechanisms to protect the rights of owners when making decisions on changing the common property of apartment buildings. The importance of increasing the level of legal culture of citizens and ensuring the openness of information on the procedure for redevelopment is emphasized.
