Legal regulation of the low-rise building sector housing construction: problems and prospects

The article considers one of the most important spheres of modern urban development in Russia, it is low-rise housing construction. The concept of low-rise housing construction is given. It is noted that today low-rise construction is the most popular type than apartment buildings. The fundamental advantages of low-rise housing construction are outlined. The measures of state support of citizens willing to buy or build their own individual house are analyzed. Despite the growing need for housing and a huge number of construction companies, it remains in question due to low quality. The analysis of the provisions of the Federal Law № 476-FZ dated December 30, 2021 and the Resolution of the Constitutional Court of the Russian Federation № 55-P dated December 28, 2021 shows that there are gaps concerning the procedure for owners to join a real estate owners’ association, as well as liability measures for developers who abuse their right to overestimate the costs of common property. The paper analyzes the problems of development of low-rise building projects in Russia, which are faced not only by developers, but also by potential buyers. The lack of unified standards for low-rise construction in the legislation, lack of qualified specialists in this area, lack of competent architectural planning, violation of construction technologies and use of low-quality building materials, widespread refusals to citizens in obtaining rural mortgages, insufficient state and technical control by supervisory authorities over the sphere of low-rise residential construction, all this indicates the need for revision of the existing legislation, and the need to improve the quality of its implementation. The conclusions about the prospects of their realization for solving the problems of sustainable development of suburban and urban areas are formulated.
