Legal regime of works whose copyright holder is unknown (orphan works): prospects for Russian legislation

The article analyzes the legal problems of works whose authors are unknown or unidentified. The authors of the article examined the main provisions of bill No. 411043-8 «On amendments to part four of the Civil Code of the Russian Federation (in terms of establishing the procedure for using certain objects of copyright and related rights, the copyright holders of which are unknown)», prospects for the implementation of the proposed mechanism for the legal regime of «orphan works». Ways to solve the identified problems are proposed.
