The article is devoted to the study of the institution of legal restrictions in special conditions (during periods of a state of emergency, martial law and during a counter-terrorism operation) from the perspective of the functioning of the administrative and legal mechanism for the protection and protection of the constitutional rights and freedoms of Russian citizens. The author, analyzing the regulatory legal framework in this area, states that in special conditions, the restriction of human and civil rights and freedoms should be carried out in strict accordance with constitutional norms and norms of federal legislation, and also that the improvement of the regulatory legal framework and law enforcement practice in the field under study should be implemented within the framework of the specification of international law, with taking into account the dominant role of the Constitution of the Russian Federation as the basic law of our state.
