Law traditions and innovations in a transitive society

The author explores the features of the law development of a transitive society. On the basis of a phenomenological analysis of law reality in the context of social transit, it is noted that the legal development of a society in a transitive state is characterized by the primacy of doctrine in the development of the law system, legislative activism, the situational nature of lawmaking, access to the lawmaking of society, the rejection of law tradition, crisis riskiness. The development of Russian society is considered from the standpoint of its transitivity as an essential feature.
