Presentation of a person for identification in conditions that exclude visual observation of the recognizer by the identifiable: certain criminal proceeding challenges and their solutions

Introduction: the authors discuss questions connected to presentation of a person for identification in conditions that exclude visual observation of the recognizer by the identifiable. The authors also figured out issues arising when conducting the investigative activity, identified ways of solving them. Materials and Methods: the present study is based on the provisions of the current criminal procedure legislation, as well as the results of research by scientists devoted to the identified issues. The results of the study were obtained during the application of general scientific and private scientific methods of cognition of legal reality. Among them, analysis, synthesis, system-structural approach, comparative legal method, sociological survey, etc. should be highlighted. Results: in the course of this study, the authors examined in detail the problems of producing a person for identification in conditions that exclude visual observation, as well as issues of ensuring the safety of participants in the named investigative action. The technical means and methods that facilitate the preparation and conduct of the presentation for identification are considered. The investigative and judicial practice of producing the presentation of a person for identification in conditions excluding visual observation is analyzed. The study also takes into account the latest achievements of technological progress and changes in the current legislation in terms of regulating the investigative action under consideration. Discussion and Conclusions: conclusions are formulated about some features of the production of the presentation of a person for identification in conditions that exclude observation. The most optimal forms of presentation for identification are proposed in order to ensure the safety of its participants from criminal encroachments caused by criminal prosecution.
