Caution as a possible form of operational-investigative prevention of illegal migration

Introduction: the authors consider the problems of operational-investigative prevention of illegal migration. An attempt to solve the current problem of the lack of bodies, carrying out operatively-search activity, effective mechanisms of preventive effects on persons engaged in the preparation for the committing organization of illegal migration and other crimes was taken. The aim of this work is the search for efficient legal possibilities of preventive influence on these individuals and the formation of appropriate proposals to the legislation. Materials and Methods: the main methods of the research were the survey of employees of the operational divisions and the analysis of existing legal acts. The study proposes to grant the right to the bodies implementing operative investigative activities, to declare an official warning about the inadmissibility of actions creating conditions for committing offences in the absence of grounds for imposition of the statutory liability.
