Prejudice of the courts’ decisions, confirming debts, for including in the register of creditors

In this article author investigates the question of prejudice of the courts ’ decisions, which confirm debts, for including such requirements in the register of creditors. Author concludes that such courts ’ decisions aren’t obligate in the bankruptcy procedure for court-appointed administrator and other creditors, who can object to such requirements, if they aren’t well-grounded. Besides author analyzes the efficiency the legal mechanism of creditors ’ rights protection, which is described in the Resolution of the Supreme Arbitration Court №35, accepted in 22.06.2012. This mechanism needs to be improved by confirmation of courts’ rights in the bankruptcy procedure to check all the requirements to the debtor, including such of these, which are founded on the courts’ decisions, accepted before beginning of bankruptcy procedure.
