Reasons for canceling and changing the court's decisions in the cassation institution

Amendment or cancellation of a judicial act in the framework of cassation review occurs when significant violations of substantive or procedural law that have affected the outcome of the case are established. Among researchers, the most relevant question is how significant such a violation should be, and how such a violation should affect the outcome of the case. The main difficulty lies in the fact that the provisions of the Civil procedure code of the Russian Federation do not disclose the concept of "significant violations", which should be considered as the basis for revoking or changing the decision. There are also no explanations in the acts of the constitutional Court and the Supreme Court.
