Preparation for crime: qualification questions

The article is devoted to the qualification of crimes committed at the stage of preparation. The paper reveals the legal significance of the preparation stage and addresses the issue of sentencing for this activity. Particular attention is paid by the author of the article to the main problematic issues of qualification of preparation for a crime, and ways to solve them are proposed. The article outlines the basic conditions for the proper qualification of preparation for a crime, which arise from the law and have developed in law enforcement practice. The author reveals the essence of the questions raised, illustrating with examples from the practice of courts of general jurisdiction on the basis of the sentences passed, as well as through the key positions of the Plenum of the Supreme Court of the Russian Federation.
