This article examines the issues of the application of Article 169 of the Civil Code of the Russian Federation. In particular, it is noted that the provisions of this article are used to apply confiscatory measures to acts that are not transactions. Particular attention is paid to the teleological interpretation of Article 169 of the Civil Code of the Russian Federation, which in its new version is an extraordinary punitive measure permissible only if there is a special rule. The issue is considered on the basis of an analysis of a specific case that has passed three stages of cassation review, including the review by the Supreme Court of the Russian Federation.
