Addition to the issue of constitutional and legal protection of the assembly members' term of office

In this article author investigate present problems in our constitutional-legal system of lawful protection of parliamentary term. In starting of extended appearance of violate constitutional principle of free parliamentary term in our parliamentary practice, author considers legally unacceptable that parliamentary term is not lawful protected in domestic legal system. With analyze of current legal regulation, which make sure only lawful protection of electoral law in electoral procedure in courts and the other state institutions, and practice of Constitutional Court and Supreme Court of Republic of Serbia in disputes because of loss parliamentary term especially envisages possibilities of establish competence of Constitutional Court of Serbia in this disputes, in based of his competence to decide in electoral disputes which is not in competence of courts and the other state institutions. In the purpose of realization of constitutional principle of lawful protection of human rights and principle of free parliamentary term author prefer wide interpretation of this constitutional rule, which enable establish of competence of Constitutional Court in disputes because of loss parliamentary term. Author citations that in present situation of legal regulation exist define procedural-lawful disturbances for offering direct parliamentary term and thinks that this disturbances could be denied with appropriate legislative interventions, but he flows out that lawful vacancies can be completely denied only with new constitutional solutions. In this meaning, with respect international and comparative standards in this field and following from specific lawful nature of disputes because of loss parliamentary term in relation with classical electoral disputes, author gives his opinion of new constitutional solutions about this protection.
