Application of measures of procedural coercion against entrepreneurs: current problems and ways to solve them

The paper emphasizes that measures of procedural coercion have a significant impact on participants in criminal proceedings in terms of the implementation of not only procedural, but also other rights, including labor, housing, etc. At present, the issue of the impact of procedural enforcement measures on business activities and their effectiveness has become relevant. The legislator takes measures to limit the possibility of unreasonably detaining entrepreneurs, introduces prohibitions for this purpose, and expands the procedural status of entrepreneurs. However, the analysis carried out in the paper shows that it is not possible to significantly improve the situation, and difficulties remain. In this regard, the author’s vision to solve this problem is presented, which lies in the plane of increasing the responsibility of officials of the preliminary investigation bodies for the decisions taken and their justification.
