Application of Unidroit principles of international commercial contracts (principles) in the practice of state arbitration courts

The legal characteristics of the Principles is set out in the Article, which represent a new universal approach to the International Trade Law and constitute a set of basic rules regulating conclusion and performance of international commercial contracts reflecting approaches of different legal systems. When endorsing the Principles UNCITRAL noted that this document contain a universal set of provisions regarding international commercial contracts, which supplements a whole range of documents in the sphere of International Trade Law, including a United Nations Convention on International Sale of Goods (Vienna, 1980). The Principles are in widespread use in international commercial arbitration as well as in state arbitration courts in our country. The Article lists the court rulings in economic and administrative cases and gives the following grounds for application of the Principles: interpretation of specific Articles of the Civil Code of the Russian Federation, confirmation of position of the state arbitration court by a reference to the relevant Article of the Principles, calculation of damages.
