Application of the mediation procedure in enforcement proceedings

In this paper, a study is made of the possibility of using an alternative method of resolving a dispute - mediation in the framework of enforcement proceedings. The main conclusions outlined by the author are outlined, for example, today, for a more active use of mediation at the stage of enforcement proceedings, it is necessary to provide for the possibility of suspending enforcement measures for this period without removing the imposed arrests, so as not to provide this time to the debtor for the alienation of property. It is also necessary to change the procedure for collecting the performance fee. We believe that the bailiff should be endowed with the right to conduct conciliation procedures, as well as the right to approve a settlement agreement in enforcement proceedings.
