Application of lex mercatoria by Russian courts in intellectual property disputes

Purpose: Study of lex mercatoria as a source of legal regulation of intellectual property relations in the legal practice of the Russian courts. Methodology: We used a comparative legal, historical, legal and formal-legal methods. Results: The article presents the analysis of the concept of lex mercatoria from the perspective of the fitness of a given legal category to the sources of the Russian private international law in the regulation of cross-border intellectual property relations. Novelty/originality/value: The article is one of the first attempts to explore the possibility of using non-state regulators in the field of intellectual property.
