Justice availability should be considered as a guarantee of a quick and efficient mechanism of achievement of the intended effect of restoration of the original position which existed before the violation of subjective rights and interests. The decisions of European Human Rights Court also the decisions connected with Convention explanation are of case character. The project on improvement of the Russian procedural legislation and adequate law-enforcement practice, in particular judicial should be worked out taking into consideration legal views of the given court.
