The principle of division of powers in works of domestic scientists

This article discusses and analyzes the views of various domestic scientists on studying the principle of division of powers as a component of the legal state. The relevance of the topic shows that the Russian state as a legal one should be based on the foundations inherent to such states. However, many principles which have been developed by the scientists of the Age of Enlightenment fail to meet modern requirements. The principle of division of powers is one of the fundamentals of the legal state that is indispensable for an appropriate functioning of the public authority in order to ensure the rights and freedoms of citizens. The scientific novelty is an attempt to systematize views of scientists of the pre-revolutionary, post-revolutionary and modern era by comparison with their views on nature and essence of the division of powers as a principle of the legal state.
