Principle of freedom of agreement when concluding a contract for the supply of goods for state and municipal needs

The article analyzes the controversial issues of applying the principle of freedom of agreement in the state and municipal procurement. The author comes to the conclusion that the legislator has established a significant number of essential conditions, which must necessarily contain a contract for the supply of goods for state and municipal needs, including the subject of such an agreement, its price, terms and procedure for the supply of goods, the responsibility of the parties and other conditions, which leads to limitation of the principle of freedom of contract. However, this restriction seems to be fair due to the priority of public interests in contractual relations.
