The possibility of coercive obtaining of biological samples for comparative examination under modern criminal and procedural law and emerging investigation and court practice are considered in the article. The imperfection of the existing regulation is demonstrated in the article. Recommendations for law enforcement officers, following which allows determining the degree of admissible coercion when obtaining biological samples for comparative examination are suggested by the author. It is proposed to assess obtaining of biological samples from individuals as lawful, reasonable, proportionate and excluding humiliation of person's dignity and honor as well as not threatening their health and lives.
