Acquisition of ownership rights to ownerless linear facilities by municipalities and operating organizations

The article examines the problem of competition between the legal claims of municipalities and operating organizations in relation to ownerless linear objects, which arose after amendments were made to Article 225 of the Civil Code of the Russian Federation. The importance of registering such objects for the purposes of further recognition of property rights in court is assessed. The legal nature of the claim for recognition of ownership of an ownerless linear object and the legal positions developed in judicial practice are analyzed. The author proposes criteria formulated by the author for resolving disputes regarding the recognition of ownership rights to ownerless linear objects.
