The relevance of the study of the relationship between the defendant and the defender lies in the fact that the defender, being a professional participant in criminal proceedings, is obliged to coordinate his position with his client. On the other hand, the defense attorney may not agree with the defendant’s opinion, which entails difficulties in terms of the psychological aspect of their interaction. The author concludes that the legal position of the defender as a subject of proof and his client, who has a broad procedural status, allows them to establish psychological contact on the basis of trust, attorney-client privilege, consistency of positions, which is extremely necessary for the realization of the right to defense in a fair hearing and resolution of a criminal case in the proceedings of the court of first instance.
