Signs of the enslaving transaction

The article gives a detailed analysis of features, necessary to determine the enslaving transaction as onerous and as a consequence its invalidity. It is dealt with the historical aspect of the onerous transaction in our country and in Germany, where onerous transactions have a long history. Also, the author paid attention to different opinions and points of view of various authors on the subject. The article specially noted the judicial practice dedicated to the recognition of transaction as onerous. It is analyzed judicial decisions of the higher courts related to the issue under consideration. The author identified limitations in the field and formulated recommendations for their elimination.
