Guilty plea: criminal law and criminal procedure aspects

Introduction: the article analyzes guilty plea from the perspective of criminal and criminal procedure legislation. According to the current Criminal Code of the Russian Federation, when applying punishment, a law enforcement officer may take into account extenuating circumstancess that are not provided for by the criminal law. The Criminal Procedure Code of the Russian Federation establishes a strict procedure for obtaining a confession that does not take precedence over other evidence. The presence of a guilty plea is a prerequisite for the implementation of criminal proceedings in simplified forms. Materials and Methods: during the study, the dialectical-materialistic method are used. In its framework, we use linguistic, logical-legal, comparative-legal, statistical and other methods of scientific knowledge to analyze individual aspects of the topic.
