This work reveals the concept and essence of material evidence in a criminal case, touches upon the problem of recognizing objects as material evidence; confiscation of relevant items from persons without procedural status as a suspect, an accused, and examples of law enforcement practice are given on the basis of the positions of the higher courts and acts issued by the lower courts of the Russian Federation. In addition, it should be noted that the article addresses some of the problems associated with the application of legislation on physical evidence.
