The problem of implementing the anti-corruption mechanism from the standpoint of the constitutional principle of independence of the local government system

Бесплатный доступ

The problem of implementing anti-corruption mechanisms in relation to local governments is considered. It is shown that their independence is guaranteed at the constitutional level, but government intervention is allowed within the necessary limits. It is concluded that in the field of anti-corruption there is uncertainty in the specific ways in which such intervention should be ensured. This conclusion is confirmed by specific examples, based on the analysis of which it is shown that the problem of a private nature is the uncertainty of the form of the court decision; in a more general sense, the problem lies precisely in the limits of intervention, taking into account the independence of local government. It is shown that the appropriate form of its implementation when implementing the anti-corruption mechanism is a court decision to remove the head of the municipality.
