Problematic aspects of ensuring the participation of a lawyer during the search during the preliminary investigation

Purpose of the study is Optimization of the procedure for providing a lawyer to participate in the search conducted by officials of the preliminary investigation bodies at the pre-trial stage of criminal proceedings. The method of analysis and formal legal method were used in the article. Proposals have been developed to strengthen the guarantees of independence of ensuring the participation of a lawyer in the conduct of a search at the pre-trial stage of criminal proceedings. The article contains specific proposals for improving the criminal procedural legislation in order to strengthen the guarantees of independence of ensuring the participation of a lawyer in the course of the search conducted at the pre-trial stage of criminal proceedings by officials of the investigation and inquiry bodies.
