Problematic issues of applying by police officers of article 27.12.1 of the Administrative Code of the Russian Federation "Medical examination for the state of intoxication"

The article analyzes the problems of applying by police officers of Article 27.12.1 of the Administrative Code of the Russian Federation, which regulates medical examination for the state of intoxication of persons who have committed administrative offenses. The main reason for the existing problems, in the author’s opinion, is that offenders have a practical opportunity to evade this measure of ensuring the proceedings in an administrative case. The author’s view on their solution is proposed, which assumes the justification of the illegality of such behavior, the solution of qualification issues and the definition of directions for further development of administrative legislation.
