Problems and prospects of applying the personal debt restructuring procedure: analysis of law enforcement practice

The article is devoted to analyzing the problems and prospects of applying the personal debt restructuring procedure in Russian law enforcement practice. The regulatory requirements for restructuring are examined, and key difficulties are identified, including strict solvency criteria, creditor dependence, and the priority of liquidation procedures. Directions for legislative improvement are proposed, including the introduction of compulsory approval of restructuring plans and the development of out-of-court mechanisms. Implementing these changes will enhance the accessibility of rehabilitation procedures and the effectiveness of restoring citizens' solvency.
