Challenges and opportunities for interaction between subjects of legal relations in the field of waste management

The article examines the subject matter of legal relations in the field of solid municipal waste management. Regulation gaps in the relationship between the actors involved in the system have been identified. It appears that the activities of regional operators are inherently aimed at achieving socially beneficial goals rather than making a profit, as reflected in legislation and practice. In addition, it should be transparent and the results of such activities should be made publicly available on the organisations' websites and special eco-portals. Proposals have been formulated to improve the current legislation in the sphere of MSW management, in particular concerning the legal status of its subjects. Amendment of the Town Planning Code with a mandatory requirement for the commissioning of a waste collection and sorting acceptance certificate for the purpose of forming the infrastructure of new collection sites is proposed, and the regional operator should be empowered to sign an acceptance certificate for waste collection and sorting works.
