The article analyzes the constitutional and legal protection of entrepreneurship, and draws conclusions about the current state of this institution. It is indicated that the mechanisms for the protection of entrepreneurship can be considered a fairly effective legal instrument for the protection of the legitimate interests of entrepreneurs. The authors come to the conclusion that this institution is designed to resolve the conflict in order to avoid a violation of the balance in the business environment
