Problems of qualification of fraud in the field of insurance when establishing the signs of the main corpus delicti

Federal Law №207-FL of 29.11.2012 "On Amendments to the Criminal Code of the Russian Federation and Certain Legislative Acts of the Russian Federation" included special compositions providing for criminal liability for fraud (including Article 159.5 of the Criminal Code of the Russian Federation). Insurance fraud has a special composition related to insurance legal relations. However, in the theory and practice of the application of this article, there is currently no consensus on some elements of the composition of this crime.
