Problems of qualification of creation, use and distribution of harmful computer programs

Article is dedicated to some troubles witch arising in the qualification of crimes in the sphere of computer information. Shows the different points of view, and on this grounds proposing ways of improving current legislation. In article suggestions for improvement of the existing Russian criminal legislation in the sphere of information security are formulated.
