Problems of qualification of abuse of office

The article discusses some issues of legislative regulation and qualification of abuse of official authority. The author identifies the problems of criminal law assessment of objective and subjective signs of abuse of official authority, and suggests ways to solve them. The author examines the issues of qualification and delineation from related offences of the act provided for in Article 285 of the Criminal Code of the Russian Federation. The problems of mixing concepts contained in the norms of the law and the impact of this process on the work of law enforcement agencies are also considered. Proposals are being made that could potentially contribute to optimizing criminal legislation and filling gaps in the law.
