Problems of validity and reasonableness of the resolution of judgment of conviction without imposing punishment in connection with a change in the situation in a special order of the judicial proceedings provided for in chapter 40of the Criminal Procedure Code of the Russian Federation

In the article, based on the analysis of the criminal procedural law and law enforcement practice, the author casts doubt on the possibility of the court well-grounded and motivated decision on release from punishment in connection with a change in the situation in a special order of judicial proceedings provided for in Chapter 40 of the Criminal Procedure Code of the RF. In this regard, the author proposes to provide for a provision in the Criminal Procedure Code of the Russian Federation according to which the issue of release from punishment in connection with a change in the situation can be considered only in the general order of judicial proceedings.
