Problems of restriction of human rights and freedoms

This article is devoted to the study of restrictions on the constitutional rights and freedoms of man and citizen in the context of the direct operation of the Constitution of the Russian Federation. Based on the analysis of constitutional practice and taking into account the legal positions of the constitutional Court, the author considers the problematic issues of such restrictions and identifies possible ways to solve them. Taking into account the use of international legal instruments, such as: The universal Declaration of human rights and the Convention for the protection of human rights and fundamental freedoms, the author develops separate grounds for restricting human rights and freedoms, as well as mechanisms for improving the legislation.
