Problems of liability in bankruptcy cases

The article draws attention to the contradiction between the scale of manifestations of criminal bankruptcy and the extremely small number of persons brought to criminal and administrative liability for such offenses. To remove this contradiction and ensure effective justice in the field of bankruptcy, it is proposed to concentrate the consideration of all disputes on bringing to criminal and administrative liability for abuses associated with bankruptcy in arbitration courts in bankruptcy cases, allowing the use of a private prosecution model.
