Problems of law enforcement practice of deprivation and restriction of parental rights

This article is devoted to the problems of law enforcement practice of deprivation and restriction of parental rights. As part of the study of this topic, the problems faced by the courts when depriving and restricting parental rights were considered. In addition, attention was paid to the ambiguity of judicial practice in this category of cases. After analyzing this topic, we came to the conclusion that the legislation should establish a clear distinction between the grounds for the deprivation of parental rights and the grounds for the restriction of parental rights. Since, according to the considered judicial practice, the decision on whether to restrict specific parents or deprive them of their parental rights is made exclusively by the court at its discretion.
