Problems of legislation protection of citizens’ participation in crime prevention and suppression

Changes in legal consciousness generate social activity of the population, which is manifested in the desire of citizens to participate in crime prevention activities. The existing legislation does not allow the full use of the anti-criminal potential of the population due to the presence of gaps, contradictions, material and technical shortcomings. This is most clearly manifested in matters of criminal law protection of the life, health, honor and dignity of freelancers and members of public law enforcement organizations, legitimation of their rights and functional duties to suppress and prevent crimes and offenses. All this predetermines the need to form a new approach to the legal support of citizens' participation in the protection of public order and the prevention of offenses. The author analyzes the legal status and issues related to the procedural detention and armament of citizens who voluntarily perform actions to neutralize and eliminate criminogenic determinants. Solutions to certain problems of legal support are proposed by introducing amendments and additions to the Code of the Russian Federation on Administrative Offenses, the Criminal Code of the Russian Federation, the Code of Criminal Procedure of the Russian Federation, Federal Law: No. 44-FZ of April 2, 2014.
