Problems of legal regulation of lease legal relations in entrepreneurial activities

The article is devoted to the analysis of the main elements of the lease agreement, the main problems of conclusion and maintenance of lease agreements are considered, the views of legal scholars and the results of law enforcement practice on the main aspects of the lease agreement between subjects of entrepreneurial activity are presented. The convenience of using the design of lease legal relations in the economic activity of subjects of civil turnover does not cause any doubts. The lease agreement is widely used by legal entities and entrepreneurs for procurement, production of works, services and goods for both state and municipal needs. The fact that the state pays great attention to the institution of lease legal relations in entrepreneurial activity is confirmed by a number of amendments adopted in 2020 during the pandemic period. These include the Federal Law of April 1, 2020 «On Amending Certain Legislative Acts of the Russian Federation on the Prevention and Elimination of Emergency Situations», Resolution of the Government of the Russian Federation of April 3, 2020 № 439 «On Establishing Requirements for the Conditions and Terms of Deferral of Payment of Rent under Real Estate Lease Agreements», etc. Often in lease legal relations the landlord is the most prepared. In most cases, leasing out property is the main type of activity for the lessor and an integral part of business for the lessee. The practice of recent years shows how important it is to observe and think over the rules of concluding a lease agreement between subjects of entrepreneurial activity. In most cases, entrepreneurial activity begins with the conclusion of a lease agreement. In this article we will talk about the lease of premises, offices, retail space, warehouses and production facilities. As a rule, when concluding a lease agreement, subjects of entrepreneurial activity pay more attention to the area of the leased premises and its rent, as for other issues, at first glance they do not seem essential, however, as court practice shows, certain nuances of lease legal relations can bring significant losses to both the lessee and the lessor.
