The article considers some problems and contradictions having arisen after introducing Chapter 40.1 into the Criminal-Procedural Code of the RF; the ways of improvement of its provisions on the basis of comparative analysis of the similar regulations in the present criminal-procedural legislation of other former USSR Republics are suggested.
