Problems of Legal Regulation of Prosecutorial Oversight Over the Implementation of Housing Legislation Concerning the Provision of Housing for Orphans and Children Left Without Parental Care

This article addresses urgent issues related to prosecutorial oversight of the enforcement of housing legislation concerning the provision of housing for orphans and children deprived of parental care. Although a substantial body of regulatory acts has been adopted in modern Russia, prosecutorial practice continues to reveal numerous violations arising from the failure to ensure housing for these vulnerable groups. There is a clear need to move from reactive measures addressing identified violations toward proactive prevention. The study finds that the current legal framework in this area contains significant gaps. In practice, guardianship and custodial authorities frequently fail to fulfill their direct responsibilities, including the registration of children for subsequent allocation of housing. Moreover, the legislation does not establish a clearly defined obligation for the competent authorities to inform eligible individuals in a timely manner about their right to receive adequate housing. The article outlines potential solutions to these legal challenges, such as amendments to existing laws and subordinate regulatory instruments.
