The enforcement problems of the law on the responsible parenthood of the Republic of Sakha (Yakutia)

The paper analyzes the provisions of the Law on Responsible Parenthood adopted in the Republic of Sakha (Yakutia) that cause problems during full, direct and immediate application of the law. The Law No. 1604-З N 737-V on Responsible Parenthood dated 14 March 2016 enshrined by the deputies of the State Assembly (Il Tumen) of the Republic of Sakha (Yakutia), its expected and real potential in legal and social consequences are the scope of study. The Yakutsk Regional Department of the All-Russian Public Movement Mothers of Russia initiated the adoption of the law. The document was developed by the State Committee of Justice of the Republic of Sakha (Yakutia). The above-mentioned law is relevant due to its novelty, and because of its negative perception in public it has a high-profile nature of a law with the elements of the Western juvenile justice system which is strongly criticized in order not to be implemented in the Russian Federation. The hard enforcement of any law is an indicator of its quality. Against the background of active federal lawmaking, the regional legislative activity is still insufficiently studied. Whereas in some cases, it is the lawmaking of the constituent entities of the Russian Federation that is an example for further introduction of federal analogues into the legal space of the entire state. Thus, the law under review is a pilot project with prospects for its implementation throughout the Russian Federation or its individual constituent entities (it is stated in the explanatory memorandum to the law). The research methods include the literal, terminological, system-based, comparative legal, technical legal analysis of the Law on the Responsible Parenthood of the Republic of Sakha (Yakutia); the content analysis of professional literature, an overview of media and Internet resources; an expert interviewing; starting a focus group involving different legal experts (lawyers, judges, investigators, prosecutors, internal affairs officers); the opinion poll.
