Problems of holding liable for repeated non-compliance with restrictions established under administrative supervision

The article considers the institution of administrative prejudice, its characteristic features are highlighted. The basic criteria that are used in the construction of prejudicial compositions are studied, recommendations on the application of these criteria for a unified description of compositions with administrative prejudice are given. The prejudicial composition, providing for the establishment of responsibility for repeated non-compliance with the established restrictions by the supervising person is analyzed, and difficulties in its practical application are revealed. The experience of the CIS countries in securing similar prejudicial compositions involving liability for repeated failure to comply with the restrictions established under administrative supervision is investigated and evaluated. Taking into account the theoretical and practical aspects of the study, as well as positive foreign experience, proposals aimed at improving the legislation that criminalizes repeated violation of restrictions by a person who has been subject to administrative supervision are formulated.
