Problems of realisation of rights in the context of the Russian specifics: historical-legal aspect

The article investigates the problem of implementation of the provisions of the Soviet constitutions. It identifies cause-effect relationships of discrepancies between the realities of life the Soviet period and the constitutional norms. The fact that this problem is of complex character in Russia, that roots of this phenomenon go deep in the historical past is established. The fundamental aspects of specifics of the Russian statehood which affect the application of the law are the special role of the state in our society, ideological factor, centuries-old traditions of law enforcement, catching up, revolutionary character of transformations in the Russian society and peculiarities of mentality grounds of state power and law.
